The Town of Aurora is modernizing our current noise bylaw to ensure that Aurora continues to be a safe, inclusive and enjoyable community for all of our residents. After extensive research and public consultation we now have proposed changes for the bylaw which aim to strike a balance between respecting property rights and providing flexibility for events like birthday parties, weddings, and religious holidays.

The existing noise bylaw, in place since 2006, is outdated and does not address current community expectations, changing legislative requirements, and recent changes to the Municipal Act that have changed the authority and scope of Municipal Noise By-laws.

Noise Bylaw proposed changes

  1. Noise Exemption Permit Construction projects may apply for relief for work that meets the criteria established in Section 3 of the proposed by-law. The exemption process will provide authority to the Manager of Bylaw Services to make this decision.

    Construction noise is prohibited on Statutory Holidays
    Between 8 p.m. and 7 a.m. Monday to Friday
    Between 8 p.m. Friday to 9 a.m. on Saturday
    Between 5 p.m. Saturday to 7 a.m. Monday

  2. Residential RenovationsThe current Noise By-law prohibits any noise associated with home renovations/repairs on a Sunday. The proposed by-law will allow residents to work on their decks, paint windows, and complete other household tasks on Sunday’s between the hours of 9 a.m. to 5 p.m.

    Residential Renovations are prohibited:
    Between 9 p.m. to 7 a.m. Monday to Saturday
    Between 8 p.m. Saturday to 9 a.m. Sunday
    Between 5 p.m. Sunday to 7 a.m. Monday

  3. Solid Waste Collection – In an attempt to reduce traffic on Town roadways and reduce greenhouse gas emissions from large trucks idling, the proposed Noise By-law allows for Solid Waste collection between 5 a.m. to 11 p.m. in areas that are not zoned residential or directly abut a residential area. Garbage collection is prohibited between 11 p.m. to 5 a.m. at Commercial and Industrial properties which are residential abutting.

  4. Elimination of Noise Prohibitions by Zoning - The Town proposes to eliminate noise restrictions based on Zoning and implement a general prohibition for persistent and unreasonable noise that is audible from a point of reception.

  5. Exemption Requests - The Town proposes to introduce an exemption application for construction noise. This process will give the Town an opportunity place conditions on construction activity while ensuring the general needs of the community are adhered to. An exemption request does not guarantee it will be granted.

  6. Increased Fines for Businesses and Continued Non-compliance - The Town proposes implementing a higher upper limit fine of $100,000.00 for continued offences and non-compliance.

  7. Definitions – The proposed Noise By-law has received many updates to the definitions section. Various definitions have been added, deleted, or updated to reflect changes in other forms of legislation and to support modernization.

    As part of the Town’s Noise By-law review, staff have considered the changing needs of the Town’s residents.  This includes more people who work shifts and a non-traditional work week.  Part of this review will include more flexibility for all residents, while also making sure we continue to maintain and enhance existing standards, where applicable.

    The Town does not currently include decibel levels in our Noise By-law.  As part of the comprehensive review, this was something that was considered but a decision was made not to proceed with decibel requirements.  Decibel readings are more complex than obtaining a numerical reading and require that ambient noise (traffic, vehicles, businesses, children playing, etc.) are considered at the time of measurement.  The implementation of a decibel based system also comes at a significant cost to the Town on an annual basis as training is required and the devices require calibration.  If a ventilation system is operating and it is making strange noises, this could be investigated under the Town’s Property Standards By-law from a maintenance standpoint.  If the operation of the unit is integral to the building, it would be exempt. 


    For Industrial occupancies, they are regulated by the Ministry of Environment and the Town does not generally have purview over these types of establishments.  We recently received a complaint in an Industrial neighbourhood and staff did liaise with Ministry staff and conduct a Property Standards Inspection to ensure the proper operation of any equipment.

    Fireworks have become a growing concern lately.  Our current Fireworks By-law only allows for fireworks to be discharged on Canada Day and Victoria Day, and the days preceding those days. The current Fireworks By-law does not consider religious festivals and ceremonies.  Although the noise caused from fireworks is not being addressed in this by-law review, staff will be reviewing the fireworks by-law at a future date to address community concerns.

    Staff will take this suggestion into consideration however, we are also trying to find away to provide flexibility for the growing number of shift workers who reside in Town.

    The Town does not have jurisdiction over Crown agencies and their land.  Unfortunately the GO Trains and Metrolinx are exempt from these provisions.

    Hello,

    Thank you for participating in the Noise By-law Public Consultation.  If noise from a car or motorcycle is occurring on private property and is constantly occurring, the new Noise By-law will be able to address this issue.

    Noise emitting from motorcycles or cars which is occurring on roadways, falls under the jurisdiction of York Regional Police as the Highway Traffic Act has language to address these concerns.  Unfortunately the Provincial government does not permit Bylaw Enforcement Officers to conduct enforcement for Highway Traffic Act related offences.

People work and commute long hours, and many work on Sat or Sun, let alone shifts - They need any time they can get to do outdoor chores, renos, lawn cutting, etc....Likely not after dark, but possibly in the garage up to 10pm Times have changed...."Mon-Fri 9-5" is long gone. Yes a relentless dog barking should be controlled. But children making noise ? It's a very complicated issue, but also should not be over restrictive. Unfortunately, the wonderful , Mon - Fri 9-5 days of the 60's and 70's are gone. Many do work in the garage when they come home from work. Not sure there is a solution for all.     Thanks for reaching out! 

    The proposed Noise Bylaw does deal with all aspects of Noise in Aurora. Construction noise was highlighted as a significant concern in our initial public consultation in March 2020. 

    In the scenario you provided, we would still permit these types of events. As part of the review, we recognized that some of the current restrictions for events like you’ve described were too stringent. Enforcement would continue to be on a complaint basis response system and Bylaw Services could issue a Noise Exemption Permit (as is the case now) for small, community minded events.
